Why is it compulsory to register the Gift Deed under the Registration Act?

Under Section 17 of the Indian Registration Act and Section 123 of the Transfer of Property Act, registering a gift deed of fixed property at the local Sub-Registrar office in Shivamogga or your respective location is 100% compulsory. If you just write the gift on plain paper or stamp paper without registering, it carries zero legal value in court. Without official registration, legal ownership title will not pass to the receiver, and government offices like BBMP, BDA, or Panchayats will strictly refuse to transfer the Khata or property tax records.

To legally execute a gift deed, three main rules must be followed strictly. Second, the Donee must accept the gift during the lifetime of the donor while the donor is still alive and mentally sound—if the receiver dies before accepting, the gift deed becomes totally invalid. Third, the deed execution must happen in front of at least two independent witnesses who must sign the document confirming they saw the donor sign voluntarily, without any force, threat, or pressure.

What are all the essential contents that must be written inside a Gift Deed?

The gift deed must clearly state full names, ages, Aadhaar numbers, and residential addresses of both giver and receiver. It must state pakka that the property transfer is being done voluntarily out of love and affection with zero monetary payment or consideration. It must state that the property is completely free from all bank loans, court cases, or third-party issues. Most importantly, it must give the full property schedule including survey number, door number, Khata number, exact square feet measurements, clear four directions (East, West, North, and South boundaries), and a statement that physical possession of the property is handed over to the receiver today.

What is the step-by-step process and document requirement for executing and registering the deed?

You need original property ownership papers, latest Khata certificate and extract, updated property tax paid receipts, and Aadhaar and PAN cards of donor, donee, and two witnesses. On the registration day, all four people—giver, receiver, and the two witnesses—must physically present themselves at the local Sub-Registrar office. Everyone signs the registry papers, gives thumb impressions and live photos in front of the Sub-Registrar officer, and collects the registered gift deed. After getting the registered deed, the receiver can apply for Khata mutation in the local government office immediately.
